1. Introduction and Acceptance

Welcome to Grihafy ("we", "us", "our", or the "Service"). These Terms and Conditions ("Terms") govern your access to and use of our website, mobile applications, and AI-powered Vastu analysis services.

By accessing or using our Service, you agree to be bound by these Terms. If you do not agree to these Terms, you may not access or use our Service. Please read these Terms carefully before using our Service.

2. Definitions

For the purposes of these Terms:

• "Service" refers to the Grihafy website, mobile applications, and all related AI-powered Vastu analysis features and functionalities.
• "User", "You", "Your" refers to any individual or entity that accesses or uses the Service.
• "Account" refers to a unique user account created to access certain features of the Service.
• "Content" refers to any text, images, floor plans, data, or other materials uploaded, submitted, or transmitted through the Service.
• "Premium Services" refers to paid subscription plans and advanced features available for purchase.

3. Eligibility and Account Registration

3.1 Age Requirement

You must be at least 18 years old to use our Service. By using the Service, you represent and warrant that you are at least 18 years of age and have the legal capacity to enter into these Terms.

3.2 Account Creation

To access certain features of the Service, you may be required to create an account. You may register using your email address and a password, or by signing in via a supported OAuth provider (Google, Microsoft, or Facebook). You agree to:

• Provide accurate, current, and complete information during the registration process
• Maintain and promptly update your account information to keep it accurate and complete
• Maintain the security and confidentiality of your password and account credentials (if using email/password registration)
• Notify us immediately of any unauthorized use of your account
• Accept responsibility for all activities that occur under your account
• Not authorize others to access your account or use your OAuth connection with the Service

3.3 Account Termination by You

You may terminate your account at any time by contacting us at [email protected]. Upon termination, your right to use the Service will immediately cease.

4. Description of Service

4.1 AI-Powered Vastu Analysis

Grihafy provides an AI-powered platform that analyzes floor plan images to assess Vastu Shastra compliance. Our Service includes:

• Floor plan image upload and processing using Google Gemini AI
• Automated detection of rooms, directions, and spatial arrangements
• Vastu compliance scoring (0-100 scale)
• Detailed insights on strengths, weaknesses, and critical issues
• Personalized recommendations and remedies
• PDF report generation (for Premium users, when feature is available)

4.2 Service Tiers

• Anonymous (No Account): Upload a floor plan and receive a score preview. Full report access requires account registration.
• Registered (Free Account): Run analyses and view your analysis history. Unlocking full report details requires report credits.
• Credit-Based (Paid): Each report credit unlocks one full Vastu analysis report with complete insights, room-by-room breakdown, remedies, and recommendations. Purchased credits do not expire while your account is active. A discounted intro pack is available for first-time purchasers. INR one-time purchases may be processed by Cashfree, while international and subscription purchases may be processed by Dodo Payments.

4.3 Service Availability

We strive to provide uninterrupted access to the Service, but we do not guarantee that the Service will be available at all times. The Service may be temporarily unavailable due to:

• Scheduled maintenance or updates
• Technical issues or system failures
• Third-party service disruptions (e.g., AI provider downtime)
• Force majeure events beyond our reasonable control

4.4 Service Modifications

We reserve the right to modify, suspend, or discontinue any aspect of the Service at any time, with or without notice. We may add, remove, or change features, pricing, or usage limits. We will not be liable to you or any third party for any modification, suspension, or discontinuation of the Service.

5. Acceptable Use and Restrictions

5.1 Permitted Use

You may use the Service only for lawful purposes and in accordance with these Terms. You agree to use the Service only for personal or business use related to Vastu analysis and home wellness.

5.2 Prohibited Activities

You agree NOT to:

• Use the Service for any illegal, harmful, or fraudulent purpose
• Upload or transmit any content that contains viruses, malware, or harmful code
• Attempt to gain unauthorized access to the Service, other user accounts, or our systems
• Reverse engineer, decompile, or disassemble any part of the Service
• Use automated tools (bots, scrapers, crawlers) to access the Service without our written permission
• Circumvent any rate limits, usage restrictions, or security measures
• Resell, redistribute, or create derivative works from the Service or analysis reports
• Upload floor plans or images that you do not have the right to use
• Impersonate any person or entity or misrepresent your affiliation
• Interfere with or disrupt the Service or servers or networks connected to the Service
• Use the Service to compete with us or develop a similar product or service

5.3 Rate Limiting and Abuse Prevention

To ensure fair use and prevent abuse, we implement rate limits and automated bot protection:

• Anonymous Users: 1 analysis per IP address (lifetime)
• Free Users: 3 analyses per month
• Premium Users: Credit-based access; usage limited to purchased credits

We use Google reCAPTCHA Enterprise on certain forms and actions to detect and prevent automated abuse. Your use of the Service is subject to Google's Privacy Policy and Terms of Service with respect to reCAPTCHA.

Attempts to circumvent these limits may result in immediate account suspension or termination.

6. Content and Intellectual Property

6.1 Your Content

You retain all ownership rights to the floor plan images and content you upload to the Service ("Your Content"). By uploading Your Content, you grant us a limited, non-exclusive, worldwide, royalty-free license to:

• Store, process, and analyze Your Content using AI technology
• Generate Vastu analysis reports based on Your Content
• Use anonymized and aggregated data derived from Your Content to improve our AI models and Service

This license terminates when you delete Your Content or close your account, except for anonymized data used for service improvement.

6.2 Your Responsibilities for Content

You represent and warrant that:

• You own or have the necessary rights to upload and use Your Content
• Your Content does not infringe any intellectual property rights, privacy rights, or other rights of third parties
• Your Content does not contain any unlawful, harmful, or offensive material

6.3 Our Intellectual Property

The Service, including all software, text, images, graphics, logos, trademarks, and other content provided by us (excluding Your Content), is owned by Grihafy and is protected by Indian and international copyright, trademark, and other intellectual property laws.

You may not:

• Copy, modify, distribute, sell, or lease any part of our Service
• Use our trademarks, logos, or branding without permission
• Remove or alter any copyright or proprietary notices

6.4 Analysis Reports

The Vastu analysis reports generated by our Service are provided for your personal use only. You may:

• Download and save your reports for personal reference
• Share your reports with family members, architects, or interior designers for personal projects

You may NOT:

• Resell, redistribute, or commercially exploit the reports
• Remove our branding or attribution from the reports
• Use the reports to create competing services or products

7. Payment Terms and Subscriptions

7.1 Pricing

We offer credit-based paid plans for access to full analysis reports. Current pricing is displayed on our website and may be subject to change. We will notify you of any price changes before they take effect.

Prices are displayed in your local currency (INR, USD, AED, or others) based on your detected location. INR one-time purchases may be routed through Cashfree, while international and subscription purchases are handled by Dodo Payments. The final price including applicable taxes is shown at checkout before you complete payment. Taxes are calculated and remitted by the applicable payment provider.

7.2 Payment Processing

INR one-time payments may be processed by Cashfree. International and subscription payments are processed by Dodo Payments, which acts as our Merchant of Record (MoR) for those transactions. This means Dodo Payments is the legal seller of record on those transactions — "Dodo Payments" or a related entity may appear on your bank or card statement. Dodo Payments handles payment processing, tax collection (GST, VAT, and digital services taxes as applicable in your jurisdiction across 190+ countries), and payment dispute resolution independently. Grihafy does not store your card or payment credentials on our servers. By completing a purchase, you also agree to the applicable provider terms, including Dodo Payments' Terms of Service and, where applicable, Cashfree's terms and policies.

7.3 Credit-Based Purchases

Premium access to analysis reports is provided on a credit-based model. When you purchase a plan:

• Credits are added to your account upon successful payment
• Each unlocked analysis report consumes one credit from your balance
• Credits do not expire while your account remains active
• Credits are non-transferable and cannot be exchanged for cash

7.4 No-Refund and Resolution Policy

We are committed to ensuring you receive full value from every credit purchase. Because our service is delivered digitally, all purchases are final and non-refundable once payment is completed, except where a refund is required by applicable law.

Credit-based resolution (our standard approach)

We resolve payment and service issues primarily by crediting your account with additional report credits or by fixing the underlying service issue. This lets you continue using the service without interruption. We will usually resolve issues by crediting your account when:

• A technical failure on our platform prevented report generation after a credit was consumed
• You were charged but credits were not added due to a payment processing error
• An analysis failed to complete due to a verified service-side issue

Limited statutory exceptions

We do not offer refunds for change of mind, dissatisfaction with results, or used credits. If a refund is required by applicable law, or if a charge cannot be reasonably corrected through credits or service remediation, we may issue a refund at our discretion in compliance with legal requirements.

• Where required by applicable Indian consumer protection laws or other mandatory consumer protection rules
• Duplicate or clearly erroneous charges that cannot be resolved through credits

Not eligible for refund or credit

• Change of mind after a credit purchase
• Dissatisfaction with AI analysis results, which are informational in nature (see Section 8.2)
• Credits that have already been used to unlock analysis reports

To report an issue, contact us at [email protected] within 14 days of your purchase. We will respond within 3–5 business days and work to resolve the issue by adding credits or correcting the service outcome.

7.5 Payment Failures

If a payment is not completed or fails for any reason, no credits will be added to your account. If you believe a payment was charged but credits were not received, contact us at [email protected] and we will investigate and either credit your account or otherwise resolve the issue. Payment disputes can also be raised with the applicable payment provider or your card issuer/bank, and the relevant processor will handle chargebacks independently.

8. Disclaimers and Limitations

8.1 Service Provided "As Is"

Our Vastu analysis reports are generated using AI technology and are intended for informational and educational purposes only. The Service does not provide:

• Professional architectural, engineering, or construction advice
• Legal, financial, or investment advice
• Spiritual, religious, or astrological consultation
• Medical or health-related advice

You should not rely solely on our analysis for making important decisions about property purchases, renovations, or construction. Always consult with qualified professionals (architects, engineers, Vastu consultants) before making significant changes to your property.

8.3 AI Accuracy Limitations

While we use advanced AI technology, the accuracy of our analysis depends on:

• The quality and clarity of the floor plan images you upload
• The completeness and accuracy of the floor plan information
• The AI model's ability to correctly interpret images
• The complexity of Vastu Shastra principles and their interpretation

We make no guarantees about the accuracy, completeness, or reliability of the analysis results. Different Vastu experts may have varying interpretations of Vastu principles.

8.4 No Guarantee of Results

We do not guarantee that:

• Following our recommendations will result in any specific outcome or benefit
• Your Vastu score will improve after implementing recommendations
• The analysis will detect all Vastu-related issues
• The Service will meet your specific requirements or expectations

8.5 Third-Party Services

We use third-party services to provide the Service, including:

• AI Processing: Google Gemini AI
• OAuth Sign-In: Google, Microsoft, Facebook
• Bot Protection: Google reCAPTCHA Enterprise
• Payments & Tax Compliance: Cashfree (INR one-time payments) and Dodo Payments (international and subscription payments)
• Analytics & Measurement: Google Analytics 4 (including Google Signals and Measurement Protocol)
• Error Monitoring: Sentry
• Email Delivery: Brevo
• Hosting & CDN: DigitalOcean, Cloudflare
• File Storage: Cloudflare R2
• Database: MongoDB Atlas

We are not responsible for:

• The availability, performance, or security of these third-party services
• Any data breaches, errors, or issues caused by third-party services
• The privacy practices of third-party services (see our Privacy Policy)

9. Limitation of Liability

This limitation of liability applies even if we have been advised of the possibility of such damages. Some jurisdictions do not allow the exclusion or limitation of certain damages, so some of the above limitations may not apply to you.

10. Indemnification

You agree to indemnify, defend, and hold harmless Grihafy, its affiliates, officers, directors, employees, agents, and licensors from and against any and all claims, liabilities, damages, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising from:

• Your use or misuse of the Service
• Your violation of these Terms
• Your violation of any rights of another party, including intellectual property rights
• Your Content or any content you upload to the Service
• Any actions taken by you based on the analysis reports (e.g., property modifications, construction decisions)

11. Termination

11.1 Termination by You

You may terminate your account at any time by contacting us at [email protected]. Upon termination, you will lose access to your account and all associated data.

11.2 Termination by Us

We may suspend or terminate your account immediately, without prior notice or liability, if:

• You violate these Terms
• You engage in fraudulent or illegal activities
• You abuse or misuse the Service
• Your payment method fails and you do not provide an alternative
• We are required to do so by law or court order
• We decide to discontinue the Service (with reasonable notice)

11.3 Effect of Termination

Upon termination of your account:

• Your right to access and use the Service will immediately cease
• We may delete your account data, floor plan images, and analysis reports (subject to our data retention policies and legal obligations)
• Any outstanding payments or fees will become immediately due
• Sections of these Terms that by their nature should survive termination will remain in effect (e.g., intellectual property, limitation of liability, indemnification)

12. Privacy Policy

Your use of the Service is also governed by our Privacy Policy, which explains how we collect, use, and protect your personal information. By using the Service, you consent to the practices described in the Privacy Policy.

13. Governing Law and Dispute Resolution

13.1 Governing Law

These Terms and any disputes arising out of or related to the Service shall be governed by and construed in accordance with the laws of India, without regard to its conflict of law provisions.

13.2 Jurisdiction

Any legal action or proceeding arising out of or related to these Terms or the Service shall be brought exclusively in the courts located in Thane, Maharashtra, India. You hereby consent to the personal jurisdiction and venue of such courts.

13.3 Dispute Resolution

Before initiating any legal proceedings, you agree to first contact us at [email protected] to attempt to resolve the dispute informally. We will work in good faith to resolve any disputes within 30 days.

If we are unable to resolve the dispute informally, either party may initiate arbitration proceedings in accordance with the Arbitration and Conciliation Act, 1996. The arbitration shall be conducted in English in Thane, Maharashtra, India, and the decision of the arbitrator shall be final and binding.

14. Changes to These Terms

We reserve the right to modify these Terms at any time. When we make changes, we will:

• Update the "Last Updated" date at the top
• Notify you via email if the changes are significant (for registered users)
• Display a prominent notice on our website for a reasonable period

Your continued use of the Service after any changes to these Terms constitutes your acceptance of the revised Terms. If you do not agree to the revised Terms, you must stop using the Service and close your account.

15. General Provisions

15.1 Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Grihafy regarding your use of the Service and supersede all prior agreements and understandings.

15.2 Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will remain in full force and effect. The invalid provision will be modified to the minimum extent necessary to make it valid and enforceable.

15.3 Waiver

Our failure to enforce any right or provision of these Terms will not be deemed a waiver of such right or provision. No waiver by us of any term or condition shall be deemed a continuing waiver or a waiver of any other term or condition.

15.4 Assignment

You may not assign or transfer these Terms or your rights and obligations under these Terms without our prior written consent. We may assign these Terms without restriction.

15.5 Force Majeure

We shall not be liable for any failure or delay in performance due to circumstances beyond our reasonable control, including but not limited to acts of God, war, terrorism, natural disasters, internet failures, or third-party service disruptions.

15.6 Relationship

No agency, partnership, joint venture, or employment relationship is created between you and Grihafy as a result of these Terms or your use of the Service. You do not have any authority to bind us in any respect.

15.7 Feedback

We welcome your feedback and suggestions about the Service. Any feedback you provide may be used by us without restriction or compensation to you. By providing feedback, you grant us a perpetual, irrevocable, worldwide, royalty-free license to use, modify, and incorporate such feedback into our Service.
